Intellectual Property Rights (IPR) Information
The Intellectual Property Rights (IPR) Form can be found inside your Order Forms. It's an industry-standard disclaimer where you state if you have the right to manufacture the content on your CD or DVD master. Unfortunately the form is a bit user un-friendly, so we will try to explain what each section means. IPR form by itself.
NOTE: if your master contains 3rd party music or elements, you will need to provide us something in writing which allows us to copy the rightful owners works. Licensing provides this proof. Even if you are giving away your discs for free, it is illegal for CDman to press discs containing music or files that are the property of a 3rd party without their consent in writing.
Project Title: this is the album title that is used. Please choose a word that is dominant in the artwork to make identification easy.
Distribution: Please type in the appropriate usage of your discs.
Countries: Declare the country where the distribution will take place. If you are in the U.S. 3rd party material may require that you have US licensing, if you are in Canada you will need Canadian licensing. If you declare US and Canada, then you will need two sets of contracts or a contract that includes both countries.
If you own all of the content on your CD you are the owner. If you did not create the work, then you need to obtain permission from the authors, this 'permission' is called a mechanical licence.
1. If you are NOT the Intellectual Property Rights holder for software (date files) on your master, you will need to:
Include the names of any files that you do not own (eg: quicktime.exe).
Include a print-out of your mechanical license from the 3rd party on a separate piece of paper. Additional information is provided on our Licensing page.
2. If you are NOT the owner of all the music, you will need to:
Include the name of the publisher for each song.
Provide proof of mechanical licensing for any cover songs.
Provide proof of master licensing for any 'samples' (of any duration).
Mechanical licensing applications must be made to www.harryfox.com (in the USA) or www.cmrra.ca (in Canada).
Visit our Licensing page for more details on licensing audio, such as move soundtracks.
3. If you are ordering CDROM or DVD discs that include video files and you are NOT the Intellectual Property Rights holder for all content on your master, you will need to:
Include the name of the Intellectual Property Rights holder for each video.
Provide proof of licensing for each video used.
Print Org name and Signatures: The bottom of the form simply asks for your company name, your printed name and title, your written signature, and the date. This information is used to declare ownership and that you understand the terms and conditions outlined on Pages 6 and 7 of your Order Forms.
Please be sure that you have read and understand your legal obligations before you commit to an order. You must either own the right to copy the material you are submitting, or you must be able to provide proof of licensing that gives you the right to copy the material you are submitting. It is ILLEGAL to copy Intellectual Property that you do not own or have the rights for.
